Appellant brought an application to restrain the respondent from interfering in any way with the performance of his duties and functions as the Ekenobi clan head. He also sought to restrain respondent from parading or holding out himself as Ekenobi clan head.

The injunction order was granted by the trial court. The Respondent appeal was successful. Appellant appealed to the Supreme Court.
